This website is operated by Gembonbon. Throughout the site, the terms "we", "us" and "our" refer to Gembonbon. Gembonbon offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms"). These Terms of Service apply to all users of the site. Please read them carefully.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction. A breach or violation of any of the Terms will result in an immediate termination of your Services.

 

SECTION 2 – GENERAL CONDITIONS & CONCLUSION OF CONTRACT

The presentation of products in the online store does not constitute a legally binding offer, but rather a non-binding online catalog.

By clicking the order button, the customer places a binding order for the goods contained in the shopping cart. Confirmation of receipt of the order follows immediately after the order is sent via an automated email and does not yet constitute acceptance of the contract.

The purchase contract is only concluded when we accept your order by sending a separate notification via email or by dispatching the goods.

You agree not to reproduce, duplicate, copy, or sell any portion of the Service without express written permission by us.

SECTION 3 – ACCURACY AND TIMELINESS OF INFORMATION

We endeavor to keep the information on this website up to date. The material on this site is provided for general information only. We reserve the right to modify the contents of this site at any time. It is the user's responsibility to monitor changes to our site.

SECTION 4 – PRICES AND SHIPPING COSTS

The prices stated on the product pages include statutory value-added tax (VAT) and other price components.

Price changes for future orders are reserved at any time. For contracts that have already been bindingly concluded, the prices agreed upon at the time the contract was concluded shall apply.

The applicable shipping costs will be clearly displayed during the checkout process.

Special Regulation for Shipping:

• Shipments within Germany are generally free of shipping costs (no minimum order value required).

• Shipments to our designated EU partner countries (countries selectable at checkout) are free of shipping costs for orders with a minimum value of €45.00. For order values below €45.00, the country-specific shipping costs specified at checkout shall apply.

SECTION 5 – PRODUCTS, GEMSTONE DISCLAIMERS, AND SAFETY

Certain products may be available exclusively online through the website and only in limited quantities. Returns or exchanges are handled in accordance with our Return Policy.

Since our crystals are 100% natural products, each bracelet is absolutely unique. Natural inclusions, fine internal cracks, or cloudiness are characteristic features of genuine gemstones and expressly do not constitute product flaws or defects.

We have made every effort to display the colors and images of our products as accurately as possible. However, we cannot guarantee that your computer monitor's display of any color will be accurate.

Important Notice on Gemstones (No Healing Claims): The gemstones offered by us are intended exclusively for decorative purposes or as jewelry items. They are not intended to diagnose, treat, mitigate, or cure any medical condition or disease. The descriptions and attributed properties of crystals are based on traditional lore and explicitly do not constitute medical or therapeutic advice, and should never replace the advice of a physician or medical professional.

Safety Notice for Children (Choking Hazard): Our products consist of small gemstones, beads, and/or chain pendants. These small parts can be swallowed or inhaled by children and therefore pose an acute choking hazard. Our jewelry pieces are not toys and must always be kept out of the reach of children.

SECTION 6 – BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us if unauthorized resale is suspected. In the event that we make a change to or cancel an order, we will attempt to notify you by contacting the email provided. You agree to provide current, complete, and accurate purchase and account information for all purchases.

SECTION 7 – THIRD-PARTY LINKS & TOOLS

Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials, products, or services.

Your submission of personal information through the store is governed by our Privacy Policy.

SECTION 9 – LIMITATION OF LIABILITY

We are liable without limitation for damages resulting from injury to life, body, or health based on an intentional or negligent breach of duty by us.

For other damages, we are only liable for intent and gross negligence. In the case of a slightly negligent breach of material contractual obligations, our liability is limited to the contractually typical, foreseeable damage.

Any further liability is excluded. The provisions of the Product Liability Act (Produkthaftungsgesetz) remain unaffected.

SECTION 10 – SEVERABILITY CLAUSE

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, the validity and enforceability of all other remaining provisions shall remain unaffected.

SECTION 11 – GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
